Terms & Conditions 

These Terms and Conditions govern the services provided by TC Concrete & Excavation ("the Company") to the customer ("the Client"). By accepting a quote or hiring our services, you agree to the following:

1. Scope of Work

The Company will perform the work as described in the written estimate or proposal. Any changes, additions, or "extra" work requested by the Client after the start of the project must be agreed upon in writing and may result in additional charges.

2. Payment Terms

  • Deposit: A deposit of 30% is required before work commences.

  • Final Payment: The remaining balance is due immediately upon completion of the project.

  • Late Fees: Payments not received within 30 days of completion may be subject to a late fee of 5% per month.

3. Site Preparation & Underground Utilities

  • Utilities: It is the Client’s responsibility to identify and mark all private underground lines (e.g., sprinklers, invisible fences, private power lines). The Company is not responsible for damage to unmarked private utilities.

  • Access: The Client must provide clear access to the work site for heavy machinery. The Company is not liable for damage to lawns, shrubs, or driveways caused by the weight of standard equipment.

4. Concrete Characteristics & Expectations

The Client acknowledges the following inherent properties of concrete:

  • Cracking: Concrete is prone to cracking due to shrinkage and ground movement. While we use reinforcement and control joints to minimize this, the Company does not guarantee that concrete will not crack.

  • Color/Texture: Variations in color and texture may occur due to weather conditions and material mixes. These are not considered defects.

5. Weather & Delays

Concrete and excavation work are highly weather-dependent. The Company reserves the right to reschedule work due to rain, extreme temperatures, or other "Acts of God" without penalty. We are not liable for delays caused by material shortages or site conditions beyond our control.

6. Warranty & Claims

As stated in our Refund Policy, we offer a one-year limited workmanship warranty.

  • The Company must be notified of any claims within the warranty period.

  • The Company’s liability is limited to the repair or replacement of the defective area and does not exceed the total cost of the original contract.

7. Permits & Compliance

Unless otherwise stated in writing, the Client is responsible for obtaining any necessary permits, HOA approvals, or property line surveys. The Company will comply with all local building codes.

8. Limitation of Liability

TC Concrete & Excavation shall not be liable for any indirect, incidental, or consequential damages arising from the performance of the work, including but not limited to loss of use or property value.

9. Governing Law

These terms shall be governed by the laws of the State of Oregon.
